Selena C. Smith is an associate with Davis Grimm Payne & Marra.  She graduated from the University of Oregon School of Law and spent a summer during school as a law clerk for the firm.  During law school, Ms. Smith was an associate editor of the Oregon Law Review.  She also volunteered at the local legal aid office and was awarded a pro bono certificate upon graduation for her services. 

Ms. Smith’s experience also includes interning with the in-house legal departments of a national retail company and a health services organization based in the Pacific Northwest. Prior to law school, Ms. Smith worked in the banking industry, and she graduated from the University of Oregon with a major in economics.

She currently focuses her practice on a variety of labor and employment law issues and is admitted to practice in the state of Washington.  Ms. Smith’s experience at Davis Grimm Payne & Marra has included:

• Counseled and assisted in representation of public and private sector clients regarding employment discrimination, wage and hour compliance, unemployment benefits, MSHA compliance and litigation, FMLA, ADA, FLSA, Washington’s Minimum Wage Act, Washington’s anti-discrimination laws, Washington’s family and medical leave laws, and other labor and employment law matters.
• Investigated charges, interviewed witnesses, and prepared position statements and correspondence for clients in EEOC (WSHRC), NLRB, and PERC proceedings in which many of the charges were dismissed.
• Represented clients in MSHA settlement conferences and negotiated settlement agreements favorable to our clients. Represented clients and prevailed in Office of Administrative Hearings in disputes involving unemployment benefits.
• Conducted workplace investigation regarding allegations of hostile work environment and discrimination, and prepared report documenting witness interviews, credibility determinations regarding the complainant and the person allegedly responsible for the acts, and legal conclusions.
• Assisted in trial preparation, drafted pleadings and motions, and provided research for a variety of claims involving employment discrimination, wage and hour disputes, Public Records Act litigation, and breach of contract disputes.  Also assisted in labor arbitration preparation, and drafted arbitration briefs.
• Reviewed and revised personnel handbooks, employer policies and memoranda, and codes of conduct for private and public sector clients.
• Drafted separation agreements, waivers and releases of claims, and settlement agreements for clients.
• Counseled and assisted in representation of client in NLRB proceedings regarding striking employees.  Conducted witness interviews and interviews of employees accused of strike misconduct.
